Terms of Service

These terms apply to the restincal.com website (hereinafter "the service"). The service is a free hobby project maintained by a private individual. By using the restincal.com service or registering as a user you accept these terms. If you do not accept the terms, do not use the service and stop using it immediately.

1. Nature of the service

The service is a tool for tracking calories, nutrients, weight and other health-related matters. The service is developed as a hobby project and is free to use. The service is not a medical, nutritional or healthcare service and is not intended to diagnose, treat or prevent any disease. All calculations and estimates in the service are indicative averages that may contain errors, for example due to individual variation or calculation method. If you have health goals, are pregnant, follow a special diet or have any other condition requiring a healthcare professional, consult a doctor or other specialist before using the service. The service is used entirely at your own risk, and the service operator is not responsible for any errors or omissions in the information.

2. No guarantee of results

The service does not guarantee, promise or warrant any results whatsoever (e.g. weight loss, weight gain or change in health). Results depend on the user's own choices, the accuracy of data entered and individual factors beyond the service's control. The service is used at your own risk.

3. User account and user responsibilities

Registration is done with a Google account or another supported authentication method. The user is responsible for ensuring their account credentials remain under their control alone.
The user is solely responsible for the accuracy of data they enter into the service (e.g. food entries, weight, goals). The service does not check or validate personal data entered by the user.
The minimum age for the service is 18 years. Those under 18 may use the service only with the explicit consent and supervision of a guardian. By registering or using the service the user confirms they meet these age requirements.
The user agrees not to enter into the service any unlawful, offensive, misleading or rights-infringing content.
The use of automated systems such as robots, crawlers or data harvesting tools (scraping) to collect data from the service is strictly prohibited.

4. Community content and third-party data

The service may contain foods, recipes or nutritional data added by other users, as well as information retrieved from external sources (e.g. Open Food Facts, Fineli). The service is not responsible for the accuracy, completeness or currency of such user-generated or third-party content. The user is responsible for assessing the reliability of such information before using it.

5. Limitation of liability

The service is provided "as is" and "as available", without any express or implied warranty, including but not limited to warranties of fitness for a particular purpose, freedom from errors or uninterrupted operation.

To the extent permitted by applicable law:

The service operator is not liable for any direct, indirect, incidental or special damages, loss of earnings, loss of data or health consequences arising from use of the service, inability to use the service, or use of information in the service.
The service operator's total liability to the user is, to the extent permitted by law, zero (0) euros, regardless of how the user uses the service. This limitation does not apply to the extent that mandatory legislation (e.g. consumer protection law) does not permit limitation of liability, such as in cases of intentional or grossly negligent damage.
The service operator is not responsible for service outages, maintenance, the functioning or changes of third-party services (e.g. Firebase, Google Analytics, Google AdSense), or for harm caused by force majeure (e.g. network problems, server failures or other events beyond the operator's control).
The user agrees to indemnify the operator and hold them harmless from all third-party claims, costs and damages arising from the user's breach of these terms or misuse of the service.

6. Changes and availability

The operator has the right at any time and without prior notice to change, restrict, suspend or discontinue the service or any part of it, for example for technical maintenance, misuse or excessive load. The operator is not liable for any harm resulting from this.

7. Account closure and data deletion

The operator has the right to delete a user account or block access to the service if the user violates these terms, the law or uses the service contrary to its purpose. The user can delete their account and data from within the app ("Settings → Delete account → Delete account and all data") OR request deletion of their account and associated personal data at any time by sending a request by email to support@restincal.com. The account and personal data will be deleted within a reasonable time of receiving the request, except for data that the operator has a legal obligation or legitimate interest to retain (e.g. anonymised statistics or content shared with the community under clause 8).

8. Intellectual property and user-generated content

The service's appearance, code and content (excluding user-generated content and data retrieved from open sources) are the property of the operator. Copying, reselling or otherwise exploiting the service or parts of it without permission is prohibited.

By adding foods, recipes or other content to the shared database, the user grants the service a permanent, worldwide, royalty-free and irrevocable licence to display, use, modify and share that content as part of the service for all users, including after the user's account has been deleted. Deleting an account therefore does not delete content already shared with the community.

The operator also has the right to use users' private entries (e.g. food diary, weight, goals) in anonymised and aggregated form for service development, research and statistics in a way that does not allow an individual user to be identified. This does not apply to content shared with the community (e.g. foods or recipes added to the shared database), which is always publicly visible under the chosen username, not anonymously.

9. Privacy

The conditions for processing personal data are described in the separate Privacy Policy, which forms part of these terms.

10. Applicable law and dispute resolution

These terms are governed by the laws of Finland, excluding its conflict-of-law rules. Disputes will primarily be resolved by negotiation. Consumer users always have the right to bring a matter before a consumer disputes body or a competent court.

11. Changes to terms

The operator may update these terms. Significant changes will be communicated within the service. Continued use of the service after changes constitutes acceptance of them.

12. Severability

If any provision of these terms is found to be invalid or unenforceable, this does not affect the validity of the other provisions. The invalid provision shall be replaced by an interpretation that as closely as possible reflects the original intent within the limits permitted by law.
